Small business: Consultation requirement

Failing to have documented systems, training, risk assessments and controls was evidenced in the matter of;SafeWork NSW v Zammit Ham & Bacon Curers Pty Ltd [2020] NSWDC 178 (8 May 2020)

Facts :
A worker was driving a forklift on a loading dock where the only risk control in place was a faded yellow line to alert the operator, he was close to the edge of the one metre high dock. The forklift tyre fell off the edge of the dock. The operator, who was not wearing a seatbelt was dislodged and trapped between the forklift and loading dock ramp. He sustained serious injuries.

Held :
There were no documented safety procedures, systems, traffic management plans, training, and a failure to conduct risk assessments near unprotected edges. The risks associated with mobile plant and unprotected edges was ‘foreseeable’ and the faded yellow line was inadequate.

Penalty :
$75,000.00 fine plus $25,000.00 costs

The cost to prevent the issue: $2,500.00 in guarding which took 2 hours to complete.
